New Mexico Families Eligible for Household Relief

 

Nearly 1 million families benefit from up to $1,500 in rebates, direct aid

“This summer we’ll be returning hundreds of millions of dollars in relief to families around New Mexico, protecting their paychecks and helping them cope with the rising prices of gas, groceries and other household expenses.” — Gov. Michelle Lujan Grisham

With rising consumer prices straining household budgets across the nation, Gov. Michelle Lujan Grisham and the New Mexico Legislature in 2022 approved multiple rebates for New Mexico taxpayers, as well as economic relief payments to New Mexico residents who are not required to file taxes.

The measures include:

  • A refundable income tax rebate of $500 for married couples filing joint returns, heads of household and surviving spouses with incomes under $150,000, and $250 for single filers and married individuals filing separately with income under $75,000. The rebates will be sent automatically to qualifying taxpayers who have filed a 2021 Personal Income Tax (PIT) return. No application is required. Date of issue: July 2022
  • A refundable income tax rebate for all taxpayers of $500 for single filers and married individuals filing separately and $1,000 for joint filers, heads of households and surviving spouses. The rebates will be sent automatically to taxpayers who have filed a 2021 PIT return. No application is required. Date of issue: Equal payments of $250 or $500 in June 2022 and August 2022
  • Relief payments for New Mexicans who do not file income tax returns of $1,000 for households of married couples or single individuals with one or more dependents, and $500 for households of single individuals without dependents. Those payments, also approved during the Special Session of the Legislature in 2022, were limited to a total of $20 million and were distributed through an application process with the Human Services Department. Applications are now closed.

    However, non-filers still have the option to file a 2021 New Mexico Personal Income Tax return. New Mexico residents who are not claimed as a dependent on another taxpayer’s return can file a 2021 tax return through May 31, 2023 and still be eligible for a rebate.

    Assistance in filing a return may be available from Tax Help New Mexico, which is offering sessions in September and October. More information is available by calling their offices at 505-247-3671, ext. 265 or visiting their website, TaxHelpNM.org.

  • Economic assistance for low-income New Mexicans. Applications through the Human Services Department opened at yes.state.nm.us on Sept. 26 and close on Oct. 7, 2022 at 5 p.m. Payments of at least $400 will be provided to qualified households. Applicants with the lowest incomes will have priority.
    To qualify for the relief, applicants must be New Mexico residents and have at least one of the following: a New Mexico driver’s license number, individual taxpayer identification number or social security number.

    A total of $10 million is available, and a limited number of applicants will be accepted based on availability.

    Payments will be processed by the New Mexico Taxation and Revenue Department by the end of November 2022. Applicants will be notified by mail and electronically the status of their application.

Q: Do I have to declare my rebates or relief payments on my 2022 Personal Income Tax return?

A: No, the New Mexico rebates and relief payments are not taxable income for state income tax purposes. The Department cannot comment on any federal tax consequences of the rebates and relief payments.

Q: I filed my income tax already. How do I get the rebate?

A: New Mexicans who have or will file their 2021 income taxes by May 31, 2023 do not need to take any action to get their rebates. They will receive them automatically by direct deposit or check, depending on how they received their refunds or made their payments.

Q: I haven’t received my rebate yet. Why not?

A: As of August 15, 2022, about 2.4 million rebates had been issued. There are a variety of reasons why someone may not have received a rebate yet.

The most common reason eligible taxpayers haven’t received a rebate is a problem with their tax return, such as incomplete or missing information or the department needs to verify your identity.

Taxpayers can check the status of their returns using the Taxpayer Access Point at tap.state.nm.us. Once the user has created a logon, they can log into their account and check their return information in the Personal Income Tax panel.

Taxpayers who have filed a 2021 tax return should use the Call Center (1-866-285-2996) if they still have not received any of the rebates.

Other common reasons for not receiving a rebate include:

  • Your rebate was applied to a tax debt.
  • You did not file a 2021 income tax return. New Mexico residents have until May 2023 to file a 2021 Personal Income Tax return and still qualify for a rebate.
  • You were declared as a dependent on another taxpayer’s return and don’t qualify for a rebate.
  • Your rebate was returned as undeliverable and the Department needs an updated mailing address.
  • Your tax return is still being processed or you asked for an extension. Rebates are not issued until a return has been finalized.
Q: I’ve been displaced by one of the fires this spring. Where will my rebate check go?

A: New Mexicans displaced by wildfires who are unable to receive their mail have multiple options for receiving physical checks. Those who provided direct deposit information on their tax returns will receive their rebates that way.

As of May 18, mail was being sent to the Las Vegas Post Office for Chacon, Guadalupita and Rociada residents. Residents from these areas may either pick up their mail in person at the Las Vegas Post Office; call 1-800-ASK-USPS to have their mail forwarded to a different address; or call the post office in Las Vegas at 505-425-9387 and request to have their mail delivered once a week to the Taos Post Office if they are temporarily staying in the Taos area.

Residents from other evacuated area should contact their local post office to receive their mail.

The Mora Post Office has open reopened – Mora residents should contact the post office directly.

Q: If I owe the state back taxes, am I still eligible for the rebates?

A: Yes, you are still eligible; however, the rebates may be used to offset any liability in the 2021 tax year return before issuing the remaining amount to you.

Q: Will the rebates go to people who file their taxes with Individual Tax Identification Numbers (ITINs), or just those with Social Security numbers?

A: The rebates go to anyone who has filed a Personal Income Tax (PIT) return, regardless of whether they file with an ITIN or Social Security number.

Q: What if you do not file PIT because you are on disability or otherwise are not required to file because of your income level? Will the check be going out to Seniors on SSI?

A; New Mexicans who do not file taxes can apply for the relief payments available through the Human Services Department. Applications will be available on the YES-NM website at www.yes.state.nm.us beginning at 8:00am on Monday, May 2, 2022.

All New Mexicans who do not file taxes and who are not a tax dependent of another tax filer are eligible to apply for a relief payment. However, these payments will be made on a first-come, first-served basis based on the date and time of the application. Funds are limited to the $20 million appropriated by the NM Legislature.

Q: I usually don’t file a return because of my income level. Is it worth filing a return to get the rebate that way?

A: It can be advantageous to file an income tax return even if you don’t have any tax liability. Besides access to the new rebate, low-income New Mexicans may also be eligible for refundable tax credits and rebates like the Low Income Comprehensive Tax Rebate. Refundable credits and rebates can result in a refund for filers even if they have no tax liability. If a taxpayer elects to not file a return, the HSD application will be available.

Q: Can I get both the rebate and the relief payment?

A: No. If you filed or plan to file 2021 income taxes, you do not need to do anything else. You cannot receive both the relief payment and the rebate.

Q: Do I have to file by April 18?

A: April 18 is the regular filing deadline this year. However, low-income New Mexicans who have no tax liability can file later without penalty.  But to get the rebates, a 2021 New Mexico Personal Income Tax return must be filed by May 31, 2023.

Q: Will the relief payments being issued by the Human Services Department be direct deposit or sent by check?

A: Relief payments will be sent by direct deposit when requested. Otherwise, a paper check will be issued. Applicants are encouraged to choose direct deposit, if possible, because it results in a quicker payment.

Q: How much is available for the relief payments?

A: A total of $20 million has been appropriated for the relief payments, which will be distributed on a first-come, first-served basis.

Q: If the HSD fund runs out before I get a relief payment, can I still file a tax return to get a rebate that way?

A: Yes, you have until May 31, 2023 to file a 2021 New Mexico Personal Income Tax return and still qualify for the rebates.

Q: What if I moved?

A: Update your address on your Taxpayer Access Point (TAP) account or submit Form RPD-41260, Personal Income Tax Change of Address Form to the Taxation and Revenue Department as soon as you are able to, or use your new address on your PIT return.

Q: What if my banking information has changed?

A: Direct deposit rebates are based strictly on information you provided to Tax and Rev on your 2021 Personal Income Tax return. If your banking information has changed since you filed, you will be receiving a paper check. Banking information cannot be updated for purposes of the first rebate.

Q: What if my ex-spouse owes debt from when we were married?

A: The rebate can be used to offset PIT 2021 debt only for the joint liability

Q: What if I’m filing an extension? When will I get the rebate?

A: You will get the rebate shortly after your return is processed.

Q: Who do I call if I should have received a rebate but didn’t?

A: The Taxation and Revenue Call Center at  1-866-285-2996

Q: I will not file taxes this year and plan to apply for a relief payment through the Human Services Department. When can I apply and what is the deadline?

A:  New Mexicans who do not file taxes will be able to apply for relief payments starting Monday, May 2, 2022, at 8:00am. Relief payments will be issued on a first-come, first-served basis, and will be made no later than July 31, 2022. The deadline to apply for a relief payment is 5:00pm on May 31, 2022; however, applications may be closed before May 31 if available funds run out.

To apply for a relief payment from the Human Services Department, go to the YES-NM website at www.yes.state.nm.us starting Monday, May 2. The application will be available in both English and Spanish.

Q: How much is available to my household through the Human Services Department relief payments.

A:  Married applicants will receive $1,000 for their household. Unmarried applicants with no dependents will receive $500. These payments will be made based on a first-come, first-served basis until available funds run out.

Q: When will I receive my relief payment through the Human Services Department?

A:  Relief payments will be issued by July 31, 2022. You may be able to receive your relief payment sooner if you provide information that will allow us to make an electronic deposit directly to your bank account. 

Q: What information will I have to provide to apply for a relief payment through the Human Services Department?

A:  The application for relief payments will ask you to provide information about your marriage status and the individuals who live in your household. You will also be asked to provide the names, Social Security Numbers (SSNs) or Individual Taxpayer Identification Numbers (ITINs), and dates of birth for yourself, your spouse, and/or any dependents living in your household.

Reembolsos y pagos de Alivio económico

Medidas de Alivio económico aprobadas por la legislatura de Nuevo Mexico y por la Gobernadora Michelle Lujan Grisham en 2022 van a proveer una multitud de rebates para pagadores de impuestos y también para esos residentes de Nuevo Mexico quienes no son requeridos a someter impuestos.

Un reembolso de impuesto de $500 para parejas casadas que someten su declarante de impuestos juntos con ingreso de abajo $150,000 y $250 para solteros quienes someten sus declarantes de impuestos solos y con ingresos de debajo de $75,000. Esos reembolsos aprobados durante la sesión regular de legislatura en el 2022 serán emitidos en Julio. Los reembolsos serán enviados automáticamente a los contribuyentes calificados quienes han sometido su declaración de impuestos personal para el ano 2021. No se requiere una aplicación.

Un rembolso de impuesto para todos los contribuyentes de $500 para los declarantes solteros y $1,000 para los que declaran en pareja. Esos reembolsos, aprobados durante la legislación en 2022, serán separados en dos pagos iguales, uno en Junio 2022 y el otro en Agosto 2022. Los reembolsos serán enviados automáticamente a los declarantes que sometieron sus declarantes de impuestos para 2021. No se requiere una aplicación.

Pagos de alivio para Nuevo Mexicanos quienes no someten declaración de impuestos en la cantidad de $1,000 por hogares de parejas casadas e individuales solteros con uno o más dependientes o $500 para hogares de individuos solteros sin dependientes. Esos pagos aprobados durante la sesión especial legislativa en 2022, serán distribuidos a más tardar Julio 31, 2022 y serán limitados a un total de $20 millones apropiados por la legislatura.

P: Recibí mi primer reembolso por correo con cheque. ¿Hay alguna manera de recibir reembolsos futuros por depósito directo?

R: Sí, tenemos una nueva herramienta en Taxpayer Access Point (TAP, por sus siglas en inglés) que le permite actualizar su información bancaria. Si aún no tiene una cuenta de TAP, deberá crear uno.

Una vez que haya iniciado sesión en su cuenta TAP, encontrará la opción de agregar o actualizar su información bancaria en el panel “Personal Income Tax”.

P: Todavía no he recibido mi reembolso. ¿Por qué no?

R: Hasta el 16 de junio, se habían emitido más de 700,000   reembolsos y otros 78,000 cheques en papel estaban en varias etapas de procesamiento.

Hay una variedad de razones por las que alguien puede no haber recibido un reembolso todavía, entre ellas:

  • Su reembolso está llegando por cheque y todavía se está procesando. Los cheques en papel tardan más en procesarse que el depósito directo.
  • Su declaración de impuestos aún se está procesando o solicitó usted una extensión. Los reembolsos no se emiten hasta que se haya finalizado una devolución.
  • Si la información bancaria de alguien ha cambiado desde que presentó su declaración, su depósito directo puede haber sido rechazado. En esos casos, se emitirán cheques en papel y se enviarán por correo al contribuyente.
  • Algunas personas que eligieron el depósito directo optaron por obtener un anticipo en su reembolso de impuestos de su servicio de preparación de impuestos. En esos casos, la rebaja puede haber sido enviada a una cuenta provisional creada por el preparador de impuestos y se enviará a la cuenta habitual del contribuyente.
P: ¿Y sometí mi declaración de impuestos. ¿Como recibo me reembolso?

R: Nuevo Mexicanos quienes ya hayan sometido su declaración de impuestos de 2021 por el 31 de Mayo de 2023 no necesitan tomar alguna otra acción parar recibir su reembolso. Recibirán el reembolso automáticamente por deposito directo o cheque, todo depende en como reciben su reembolso o hagan sus pagos de impuesto.

P: ¿Se debo impuestos al estado, todavía soy eligible para recibir el reembolso?

R: Si, todavía es eligible lo único es que puede que el reembolso sea utilizado para contrarrestar lo que todavía deba en el ano de impuesto 2021 antes de que le regresen lo que sobre de reembolso.

P: ¿Los reembolsos serán enviados a las personas que declaran impuestos utilizando su Número de Identificación de Impuesto Individual (ITINs) o solo a las personas que utilizan su número de seguro social?

R: Los reembolsos irán a cualquier persona que hay sometido su declaración de impuesto, sin importar que hayan usado ya sea su ITIN o Numero De Seguro Social.

P: ¿Que si no someto mi declaración de impuestos por qué estoy deshabilitado o por alguna otra razón no soy requerido a someterla por el nivel de ingresos que tengo? ¿Enviaran un cheque a personas mayores en SSI?

R: Nuevo Mexicanos quienes no someten declaración de impuestos pueden aplicar por los pagos de alivio disponibles por el Departamento de Servicios Humanos. Aplicaciones serán disponibles en el sitio www.yes.state.nm.us de YES-NM empezando a las 8:00am el Lunes 2 de Mayo de 2022.

Todo Nuevo Mexicano que no someta declaración de impuestos y que no son dependiente de otro declarador de impuesto es eligible para aplicar por el pago de alivio. Sin embargo, estos pagos serán hechos por orden de llegada, y serán basados en la fecha y el tiempo en la cual fue recibida la aplicación. Los fondos son limitados a $20 millones apropiados por la legislatura de Nuevo Mexico.

P: No someteré declaración de impuestos este ano y voy a aplicar por el pago de alivio por el Departamento de Servicios Humanos. ¿Cuándo puedo aplicar y cuando es la fecha limite?

R: Nuevo Mexicanos que no someterán declaración de impuestos podrán aplicar para pagos de alivio empezando Lunes 2 de Mayo 2022 a las 8:00 am. Los pagos de alivio serán pagados por orden de llegada y serán pagados a más tardar el 31 de Julio 2022. La fecha límite para aplicar para un pago de alivio será 31 de Mayo 2022 a las 5:00 pm; sin embargo existe la posibilidad de que se cierren las aplicaciones por que los fondos se hayan terminado antes de 31 de Mayo.

Para aplicar por un pago de alivio del Departamento de Servicios Humanos, vaya al sitio de YES-NM www.yes.state.nm.us empezando Lunes 2 de Mayo. La aplicación será disponible en Ingles y en Español.

P: ¿Qué información tengo que proveer para aplicar por un pago de alivio por medio del Departamento de Servicios Humanos?

R: La aplicación para pagos de alivio le pedirá que provea información sobre su estado civil y los individuos que viven en su hogar. También se le pedirá que provea los nombres, número de Seguro Social (SSNs) o Número de Identificación de Declaración de Impuesto, y las fechas de nacimiento para usted, su conjugue, y dependientes que viven en su hogar.

P: ¿Cuándo recibiere mi pago de alivio por medio del Departamento de Servicios Humanos?

R: Pagos de alivio serán enviados al mas tardar el 31 de Julio 2022. Pueda que reciba su pago de alivio cuanto antes si provee información que los de la habilidad de depositar sus fondos por medio de depósito directo en su cuenta de banco.

P: Usualmente no someto una declaración de impuestos por el nivel de mis ingresos. ¿Valdrá la pena someter una declaración de impuestos para recibir el reembolso?

R: Puede ser de beneficio que someta su declaración de impuestos, aunque no tenga responsabilidad fiscal. Además de acceso al nuevo reembolso, Nuevo Mexicanos de ingresos limitados pueden ser elegibles para créditos de impuesto reintegrables y reembolsos como el Reembolso Comprehensivo de Impuesto de Ingresos Bajos.

P: ¿Puedo recibir los dos el reembolso y el pago de alivio?

No. Si sometió su declaración de impuestos para el 2021, no tiene que ser nada más. No puede recibir los dos el reembolso y el pago de alivio.

P: ¿Tengo que someter mi declaración de impuestos por el 18 de abril?

El 18 de abril es la fecha de plazo para someter su declaración de impuestos este ano. Sin embargo, los declaradores de impuestos de bajos ingresos que no tiene responsabilidad fiscal pueden someter tarde sin ninguna multa. Pero para recibir el reembolso, el pagador de impuestos tendrá que someter su declaración de impuestos a mas tardar 31 de Mayo 2023.

P: ¿Los pagos de alivio de parte del Departamento de Servicios Humanos serán pagados por medio de depósito directo o cheque?

Pagos de alivio serán pagados por deposito directo cuando sea pedido. De lo contrario, un cheque de papel será enviado. Los que aplican serán animados a qué escojan deposito directo, cunado posible, por que resultara en que recibirán el pago mas rápido.

P: ¿Cuánto está disponible para los pagos de alivio?

R: Un total de $20 millones ha sido apropiado para pagos de alivio, que será distribuido por orden de llegada.

P: ¿Si los fondos de HSD se acaban antes de que reciba mi pago de alivio, puedo entonces someter mi declaración de impuestos para recibir un reembolso de esa manera?

R: Si, tiene hasta 31 de Mayo 2023 para someter su declaración de impuestos y todavía calificar para el reembolso.

P: ¿Que si me mude?

Actualice su dirección en su cuenta de Taxpayer Access Point (TAP) o entregue la forma RPD-41260, Personal Income Tax Change of Address Form Departamento de Impuestos e Ingresos lo mas pronto posible o use su nueva dirección en su declaración de impuestos.

P: ¿Que si mi información de banco cambio?

R: Use su nueva cuenta de banco en su declaración de impuestos o en la aplicación de el Departamento de Servicios Humanos si no va a someter una declaración de impuestos.

P: ¿Que si mi exesposo(a) debe impuestos de cuando estábamos casados?

R: El reembolso puede ser usado para pagar lo que se debe de la declaración de impuestos de 2021 solo utilizara para la deuda que sea de los dos.

P: ¿Que se voy a pedir una extensión para someter mi declaración de impuestos? ¿Cuándo recibiere mi reembolso?

R: Recibirá su reembolso al poco tiempo de que su declaración de impuestos se procesada.
