2023 Rebates for NM families

 

Nearly 1 million taxpayers to benefit from rebates, relief payments

“Prices for basic necessities continue to be high across the nation” said Gov. Lujan Grisham. “Our state today is in a fantastic financial position, and it’s important to me that New Mexico’s families are sharing in that success.” 

With rising consumer prices straining household budgets across the nation, Gov. Michelle Lujan Grisham and the New Mexico Legislature in 2023 approved rebates for New Mexico taxpayers, as well as economic relief payments to New Mexico residents who are not required to file taxes.

Important information on the rebates and relief payments includes:

  • A refundable income tax rebate of $1000 for married couples filing joint returns, heads of household and surviving spouses and $500 for single filers and married individuals filing separately. The rebates will be sent automatically to New Mexico residents who have filed a 2021 Personal Income Tax (PIT) return and are not declared as a dependent on another taxpayer’s return.
  • No application is required. Date of issue: Mid-June 2023.
  • Eligible residents have until May 31, 2024 to file the 2021 PIT return if they have not already done so.
  • Relief payments for New Mexicans who do not qualify for the rebates above. The amount has not been determined, but $15 million has been appropriated for the payments. There will be an application process with the Human Services Department. Distribution is expected to take place in July.

Q: I filed my income tax already. How do I get the rebate?

A: New Mexicans who have filed or will file their 2021 state income tax return by May 31, 2024 do not need to take any other action to get their rebates. Taxpayers who have received a 2021 refund by direct deposit will receive the rebate by direct deposit. All other taxpayers will receive a check in the mail.

Q: If I owe the state back taxes, am I still eligible for the rebates?

A: Yes, you are still eligible. Rebates may be used to offset liabilities only for the 2021 tax year.

Q: Do I have to file by April 18?

A: April 18, 2023 is the deadline to file 2022 personal income tax returns, although New Mexicans who have no 2022 tax liability can file later without penalty.

Remember: The new rebates are tied to 2021 New Mexico personal income tax returns, and to be eligible for the rebate, New Mexicans must have filed a 2021 personal income tax return by May 31, 2024.

Q: What if I moved?

A: Update your address on your Taxpayer Access Point (TAP) account or submit Form RPD-41260, Personal Income Tax Change of Address Form to the Taxation and Revenue Department as soon as possible.

Q: What if my banking information has changed?
A: Direct deposit rebates are based strictly on information you provided to Taxation and Revenue on your 2021 Personal Income Tax return. If your banking information has changed since you filed that return, you will be receiving a paper check in the mail.
Q: What if my ex-spouse owes debt from when we were married?
A: The rebate can be used to offset Personal Income Tax 2021 debt only for the joint liability.
Q: What if I divorced after 2021? Will my rebate be going to my ex-spouse?
A: Rebates will be issued to the person listed as the primary filer. Divorced individuals will need to work out division of rebates on their own.
Q: Will the rebates go to people who file their taxes with Individual Tax Identification Numbers (ITINs), or just those with Social Security numbers?
A: The rebates go to any resident who has filed the 2021 Personal Income Tax (PIT) return, regardless of whether they filed with an ITIN or Social Security number. Taxpayers declared as a dependent on another taxpayer’s return are not eligible.
Q: I never received my rebate in 2022. Where can I get help?

A: If you were eligible for a rebate in 2022 but never received one, please email the department at nm.rebates@tax.nm.gov.

If your rebate check was returned to us as undeliverable, it will soon be turned over to the Department’s Unclaimed Property Division. Information about searching for unclaimed property is available here.

 

Q: What if you do not file PIT because you are on disability or otherwise are not required to file because of your income level? Will the check be going out to Seniors on SSI?

A: New Mexicans who do not file taxes will be able to apply for relief payments through the Human Services Department at yes.state.nm.us. Applications will be open June 12-23.

Relief payment funds are limited to the $15 million appropriated by the NM Legislature.

Q: I usually don’t file a return because of my income level. Is it worth filing a return to get the rebate that way?

A: Yes, New Mexico residents should file a state income tax return even if they aren’t required to. Besides access to the new rebate, low-income New Mexicans may also be eligible for refundable tax credits and rebates like the Low Income Comprehensive Tax Rebate. Refundable credits and rebates can result in a refund for filers even if they have no tax liability.

If a taxpayer elects to not file a return, the HSD application will be available – but those funds are limited.

Q: Can I get both the rebate and the relief payment?
A: No. If you filed or plan to file 2021 income taxes, you do not need to do anything else. You cannot receive both the relief payment and the rebate.
Q: How much is available for the relief payments?
A: A total of $15 million has been appropriated for the relief payments.
Q: When will the relief payments be issued?
A: Relief payments are expected to go out in July.
Q: If the HSD fund runs out before I get a relief payment, can I still file a tax return to get a rebate that way?

A: Yes, you have until May 31, 2024 to file a 2021 New Mexico Personal Income Tax return and still qualify for this round of rebates. You must be a New Mexico resident and not declared as a dependent on another taxpayer’s return.

You can use the department’s Taxpayer Access Point (TAP) system to file for free. Filing electronically expedites processing and is less prone to errors than filing on paper.

To file using TAP, first create an account at tap.state.nm.us. When you log in, look for the Personal Income Tax (PIT) panel and then the “File, View, or Amend All Returns” link in the account panel. The link will take you to a page with a list of filing periods. Choose 2021 and follow the directions.

P: ¿Se le darán los reembolsos a las personas que presentan sus impuestos con Números de Identificación Fiscal Individual (ITIN), o solo a aquellos con números de Seguro Social?
R: Los reembolsos serán dados a cualquier residente que haya llenado su PIT del 2021, independientemente de si presenta un número de ITIN o de Seguro Social. Los contribuyentes declarados como dependientes en la declaración de otro contribuyente no son elegibles.
P: Nunca recibí mi reembolso en 2022. ¿Dónde puedo obtener ayuda?

R: Si fue elegible para un reembolso en 2022 pero nunca recibió uno, por favor envíe un email al departamento a nm.rebates@tax.nm.gov.
